Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of the Terms of Service between you and VICTUM GROUP, s. r. o.. It describes uses of the Tellsign Service that are prohibited.

Violating this AUP is grounds for immediate suspension or termination of your account, without refund.

1. What you may not do with the Service

1.1 Spam and unsolicited outreach

  • Send marketing communications to recipients who haven't opted in, where the recipient's jurisdiction requires opt-in (e.g. CAN-SPAM Act, CASL, GDPR, PECR).
  • Send communications without a clear and functional unsubscribe mechanism.
  • Send communications with deceptive sender names, subject lines, or routing information.
  • Continue contacting a recipient who has clearly asked you to stop.

You are responsible for compliance with all applicable anti-spam and electronic communications laws. We provide suppression-list and outreach-log features so you can comply; we do not police your outbound messages.

1.2 Data abuse

  • Use the Service to harvest personal data about individuals in violation of GDPR, CCPA, or similar laws.
  • Combine our data with other sources to build dossiers about specific natural persons for purposes incompatible with the original public availability of that data.
  • Sell, license, or otherwise transfer data exported from the Service to third parties as a standalone data product.

1.3 Service abuse

  • Reverse engineer, decompile, or attempt to extract our scoring methodology or other trade secrets.
  • Scrape, mirror, or systematically download the Service beyond what the public API expressly permits and at rates beyond the published limits.
  • Probe, scan, or test the vulnerability of any system or network without our written permission.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use automation to artificially inflate usage, defraud trial quotas, or bypass billing limits.
  • Create multiple accounts to circumvent caps or restrictions.

1.4 Illegal or harmful content

  • Use the Service to engage in or facilitate any unlawful activity.
  • Generate or distribute content that is defamatory, discriminatory, harassing, fraudulent, or otherwise harmful.
  • Infringe the intellectual property, privacy, publicity, or other rights of any third party.
  • Impersonate any person or entity, or misrepresent your affiliation.

1.5 Restricted industries

We reserve the right to refuse service for outreach to or about businesses operating in industries where automated audit + cold outreach raises elevated legal or ethical risk, including but not limited to: regulated firearms sales, adult content, gambling, cryptocurrency promotion to retail, or political campaigning.

2. Required behaviors

  • Maintain accurate account information and keep credentials confidential.
  • Honor opt-out and suppression requests promptly — use our built-in suppression list.
  • Identify yourself or your agency clearly in any outreach you send.
  • Comply with all laws of the jurisdictions where you and your recipients are located.

3. How we enforce

We may, in our reasonable discretion, take any of the following actions if we have reason to believe you're violating this AUP:

  • contact you to investigate and request remediation;
  • throttle, suspend, or terminate access to features;
  • remove offending content;
  • terminate your account, with or without refund depending on the severity of the violation;
  • report violations to law-enforcement or regulatory authorities where required by law.

4. Reporting abuse

If you believe a Tellsign user is violating this AUP, email [email protected] with the relevant evidence (account identifier, communication sample, timestamps).

5. Updates

We may update this AUP as new abuse patterns emerge. Material changes are announced by email or in-app notice. Continued use of the Service after the effective date constitutes acceptance.
